Professional misconduct is the failure of a licensed professional to meet expected standards of practice. 

With few exceptions, (physicians, physician assistants, special assistants), the OPD is charged with investigating misconduct complaints against most of the licensed professionals in NYS. 

Licensed healthcare professionals accused of misconduct in NYS can be subjected to investigations and disciplinary proceedings initiated by OPD.  

Healthcare professionals include, but are not limited to:

    • Nurses: RNs and LPNs
    • Certified nursing assistants (CNAs)
    • Pharmacists
    • Dentists
    • Physical therapists
    • Chiropractors
    • Podiatrists
    • Optometrists
    • Midwives
    • Mental health professionals

What is the Office of Professional Discipline (OPD)

The OPD is part of the NYS Education Department and investigates and prosecutes allegations of professional misconduct to protect the public.  

The OPD is assigned with investigating any complaint about misconduct against a licensed professional, no matter who files it. 

The Board of Regents, which oversees the State Education Department and OPD, has the final say on disciplinary matters and can impose penalties such as fines, reprimands or license revocation.
